By accessing or using BeSmart.ai's application(s) — including through Facebook Login, Instagram, LinkedIn, Twitter/X, or any other connected social media channel — you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

2 Description of Services

BeSmart.ai provides an AI and machine learning platform delivered through the following core products and services:

3 Eligibility

To use our services, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be barred from using our services under applicable law
• Comply with Facebook's Platform Policy and the terms of any other connected social media platform

By using our services, you represent and warrant that you meet all eligibility requirements.

4 User Accounts & Authentication

4.1 Facebook Login

Our app supports authentication via Facebook Login. When you use this feature:

• You authorize BeSmart.ai to access information from your Facebook account as described in our Privacy Policy and as permitted by your chosen Facebook permissions
• You agree to comply with Facebook's Terms of Service and Community Standards
• You acknowledge that BeSmart.ai is not affiliated with or endorsed by Meta Platforms, Inc.

4.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree to:

• Provide accurate and complete information during registration
• Maintain the confidentiality of your authentication credentials
• Notify us immediately of any unauthorized account access at security@besmart.ai
• Not share your account with others or create accounts for the purpose of abuse

5 Permitted Use

You may use BeSmart.ai's services only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable local, national, or international law or regulation
• Use the platform to access, scrape, or harvest data from social media platforms in violation of their terms
• Attempt to gain unauthorized access to any part of our systems or infrastructure
• Upload or transmit malicious code, viruses, or harmful content
• Impersonate any person or entity, or falsely represent your affiliation
• Use our AI content tools to generate spam, misinformation, or content that violates platform policies
• Reverse-engineer, decompile, or disassemble any part of our software
• Resell, sublicense, or commercialize our services without written authorization

6 Social Media Platform Compliance

Our services integrate with third-party social media platforms. You agree to:

• Use connected social media data only for the purposes permitted by those platforms' terms
• Comply with Facebook's Platform Policy and all applicable platform-specific developer policies
• Not use our platform to circumvent platform rate limits, access controls, or terms of use
• Acknowledge that social media platforms may modify their APIs or policies, which may affect features of our service

BeSmart.ai is not liable for changes to third-party platform policies that affect our service features.

7 AI-Generated Content

Our platform includes AI-powered content generation tools. You acknowledge and agree that:

• AI-generated content is provided as a tool to assist you — it is not a substitute for professional judgment
• You are solely responsible for reviewing, editing, and approving any content before publishing
• You must ensure that published content complies with applicable laws, advertising standards, and platform guidelines
• BeSmart.ai does not guarantee the accuracy, originality, or suitability of AI-generated content
• You retain ownership of content you create using our tools, subject to the licenses granted in Section 9

8 Fees & Billing

Certain features of BeSmart.ai require a paid subscription. By subscribing:

• You authorize us to charge your designated payment method on a recurring basis
• Subscription fees are billed in advance and are non-refundable except as required by applicable law
• We reserve the right to modify pricing with 30 days' written notice
• Failure to pay may result in suspension or termination of your account

9 Intellectual Property

9.1 Our IP

All software, designs, algorithms, trademarks, and content comprising the BeSmart.ai platform are the exclusive property of BeSmart.ai or its licensors. Nothing in these Terms grants you any rights in our intellectual property except as explicitly stated.

9.2 Your Content

You retain ownership of content you submit to or create through our platform. By using our services, you grant BeSmart.ai a limited, non-exclusive, royalty-free license to process and store your content solely to provide the services to you.

9.3 Feedback

Any feedback or suggestions you provide about our platform may be used by BeSmart.ai without obligation or compensation to you.

10 Privacy

Your use of our services is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the data practices described in our Privacy Policy.

11 Disclaimers

We do not warrant that our services will be uninterrupted, error-free, or free of viruses. Social media data and AI-generated insights are provided for informational purposes only.

12 Limitation of Liability

Our total liability to you for any claims arising under these Terms shall not exceed the total fees paid by you to BeSmart.ai in the 12 months preceding the claim.

13 Indemnification

You agree to indemnify and hold harmless BeSmart.ai, its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including legal fees) arising out of or related to:

• Your use of the services in violation of these Terms
• Your violation of any third-party rights, including social media platform terms
• Your violation of applicable law
• Content you submit, create, or publish through our platform

14 Termination

Either party may terminate these Terms at any time. We may suspend or terminate your account immediately if we determine, in our sole discretion, that you have violated these Terms, engaged in fraudulent activity, or pose a risk to the platform or other users.

Upon termination, your right to use our services ceases immediately. Provisions that by their nature should survive termination (including IP rights, disclaimers, and limitation of liability) will survive.

15 Governing Law & Dispute Resolution

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts of Riyadh, Saudi Arabia.

16 Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by updating the "Effective Date" and, where appropriate, notifying you by email. Your continued use of our services after changes take effect constitutes your acceptance of the revised Terms.
